Please read these Terms of Service ("Terms", "Agreement") carefully before using the Xurrency.com website and API services (collectively, the "Service") operated by Xurrency ("us", "we", or "our").

By purchasing a subscription or using the Service, you ("User", "Client") agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Account & Registration

To access our API, you must purchase an API key and provide accurate, current, and complete information, including your name and email address. You are responsible for maintaining the confidentiality of your API key and account credentials. You agree to accept responsibility for all activities that occur under your account.

We respect your privacy. Your personal information is used solely for account identification and service delivery. We will not share your email address with third parties without your permission, except as required by law.

2. License and Data Usage

Upon purchase, Xurrency grants you a limited, non-exclusive, non-transferable, and revocable license to access the API and use the provided currency data subject to the following strict conditions:

• Internal Use & Display: You may use the data for your internal business processes and display converted rates to end-users on your website or application for reference purposes.
• No Redistribution or Resale: You explicitly agree not to redistribute, resell, sub-license, or transfer the raw data to any third party.
• No Downstream Feeds: You may not use the Service to feed downstream systems, storage units, or devices that act as a substitute for the Service. You are not acquiring ownership of the data; you are acquiring a license to use it.

3. Acceptable Use

You agree not to misuse the Service. Specifically, you must not:

• Attempt to reverse engineer the API or bypass any rate limits.
• Use the Service for any illegal or unauthorized purpose.
• Interfere with or disrupt the integrity or performance of the Service.

4. Service Availability & Responsibilities

Xurrency.com strives to ensure the accuracy and reliability of our data. However, the Service is provided on an "AS IS" and "AS AVAILABLE" basis.

• Service Uptime: We are not responsible for damages or lost profits resulting from service interruptions, technical failures, or force majeure events.
• Data Accuracy: While we update our rates frequently, currency markets are volatile. We do not guarantee that the data will be error-free or perfectly real-time at the exact moment of request.
• User Responsibility: You are responsible for ensuring your application handles API responses correctly and for the consequences of any financial decisions made based on our data.

5. Duration and Termination

• Subscription Term: Pursuant to your purchase, the duration of this Agreement shall be for a period of one (1) year, unless otherwise specified in your plan.
• Suspension: Xurrency reserves the right to suspend or terminate your account immediately if we suspect a violation of these Terms (specifically regarding data redistribution).
• Notice: While we reserve the right to act immediately to protect our data, we will generally attempt to provide notice via email regarding any suspension, offering you an opportunity to resolve the issue at our sole discretion.

6. Technical Support

We provide support to ensure our API endpoint is up and running. However, we are unable to offer technical support for the integration of our data into third-party applications. Our clients are responsible for implementing the necessary integration steps within their own applications (PHP, Ruby, Python, Node, etc.).

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Xurrency be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Continued use of the Service after any such changes constitutes your acceptance of the new Terms.
